BENUTZUNG ONLINETICKETS

1. Durch Bestellung im Wege des Onlinevertriebs erklärt der Besteller (= Kunde), dass er zum Zeitpunkt der Bestellung das 18. Lebensjahr vollendet hat.

2. Bestellung: Die Bestellung erfolgt durch Anklicken der Schaltfläche „Kaufen/zum Checkout“ und stellt ein verbindliches Angebot des Kunden auf Erwerb eines Tickets (Berechtigung zur Teilnahme an der Veranstaltung) dar. WNY ist nicht verpflichtet dieses Anbot des Bestellers anzunehmen. Der Vertrag über den Erwerb des Tickets kommt nach Bezahlung mit der Zurverfügungstellung des Tickets auf der Website WNY HANDPAN SUMMER ACADEMY 9-16.Juli 2024 | Wild Naya zustande. Die Bezahlung ist dann erfolgt, wenn die Autorisierung des Geldtransfers durch die Kreditkartengesellschaft bzw. das Bankinstitut erfolgt ist. Erfolgt keine Autorisierung, ist der Vertrag nicht zustande gekommen.

 

3. Bezahlung: Die Bezahlung der Onlinetickets kann ausschließlich mittels gültigem, bargeldlosen Zahlungsmittel (z.B. Kreditkarte, elektronisch bestätigtem Geldtransfer, Bankomatkarte) erfolgen. Sofern die Person des Bestellers mit der Person des Zahlungsmittelbereitstellers nicht übereinstimmt, kann WNY den Vertragsabschluss ablehnen.

4. Zustellung/Ausfolgung des Tickets: Das Ticket kann vom Kunden unmittelbar nach Zustandekommen des Vertrages (bargeldlose Zahlung) abgerufen werden. Die Übermittlung des Tickets erfolgt mittels PDF-Format bzw. mittels Mobile Tickets an die vom Kunden bekannt gegebene E-Mail-Adresse. Das Ticket ist vom Kunden auszudrucken oder als Mobile Ticket abzuspeichern. Ist keine Zahlung gemäß Pkt. I. 3 erfolgt und wurde dennoch ein Ticket bereitgestellt, so ist WNY berechtigt dem Käufer den Zutritt zur Veranstaltung zu verwehren. II. BEDINGUNGEN FÜR DIE TEILNAHME AN VERANSTALTUNGEN WNY HAndpan Summer Academy 2023

1. Diese Allgemeinen Geschäftsbedingungen beziehen sich auf Veranstaltungen der WNY HANDPAN SUMMER ACADEMY, das sind Sommer Akademien, künstlerische Darbietungen, Workshops, Tagungen udgl. Weitere besondere Bedingungen für die Teilnahme an der Veranstaltung finden sich in der von WNY für die Veranstaltung auf der Website veröffentlichten Information. 2. Die auf der Website der WNY oder in sonstigen Veröffentlichungen der WNY enthaltenen Informationen über Inhalt und Gegenstand dienen der Vorinformation über den möglichen Inhalt der Veranstaltung. WNY ist berechtigt Änderungen des Inhalts, des Ablaufs der Veranstaltung vorzunehmen, solange dadurch nicht der Charakter der Veranstaltung vollständig geändert wird. AGB Ticketshop Seite 2 von 2 3. WNY kann den Beginn der Veranstaltung verlegen, die Veranstaltung verschieben oder absagen. Verlegung des Beginns, Verschiebung der Veranstaltung oder Absage der Veranstaltung werden spätestens am Tag vor der Veranstaltung auf der Website der WNY veröffentlicht.

4. Das für die Veranstaltung erworbene Ticket berechtigt den Kunden und/oder die in der Bestellung genannten Personen zur Teilnahme an der am Ticket bezeichneten Veranstaltung. Eine Übertragung des Tickets an nicht in der Bestellung genannte Personen ist unzulässig, ausgenommen es ist bei der Ankündigung der Veranstaltung etwas anderes angegeben. Der Besucher hat bei Eintritt zur Veranstaltung seine Identität über Verlangen der WNY nachzuweisen. Der Kunde verpflichtet sich für sich und die Inhaber der von ihm erworbenen Tickets die Hausordnung – veröffentlicht auf der Website der WNY unter www.wildnaya.com & www.wildnaya-academy.com AGBs – und die für die Veranstaltung auf der Website veröffentlichten Teilnahmebedingungen einzuhalten. Im Falle der Nichteinhaltung kann der Eintritt zur Veranstaltung verwehrt werden.

5. Preis: Der Preis für das Ticket versteht sich inklusive Umsatzsteuer in gesetzlicher Höhe. Über Anforderung des Kunden wird WNY eine den Bestimmungen des Umsatzsteuergesetzes entsprechende Rechnung ausstellen und auf elektronischem Weg übermitteln.

6. Im Falle der Absage der Veranstaltung erstattet WNY den vom Kunden entrichteten Ticketpreis. Wenn WNY den Beginn der Veranstaltung auf einen anderen Tag verschoben hat (dies erfolgt spätestens einen Tag vor dem angesetzten Beginn der Veranstaltung), so ist der Kunde berechtigt durch Mitteilung per E-Mail unter Anführung der Kartenbestellnummer den Ticketerwerb zu stornieren. Diesfalls erstattet WNY den Kaufpreis. Andere Erstattungs- und Stornomöglichkeiten oder sonstige vertragliche Rücktrittsmöglichkeiten werden ausdrücklich nicht eingeräumt; die gegenständlichen Leistungen sind gemäß § 18 Fern- und Auswärtsgeschäfte-Gesetz (FAGG) als sogenannte „termingebundene Freizeitdienstleistungen“ vom Rücktrittsrecht ausgenommen.

7. WNY haftet nicht für Schäden oder Nachteile, die aus der Absage der Veranstaltung oder der Verschiebung des Beginns der Veranstaltung (siehe Pkt. 3) entstehen. WNY haftet für Personenschäden, die aufgrund der Teilnahme an der Veranstaltung entstanden sind, ausgenommen Schäden, die durch ansteckende Krankheiten entstanden sind und ausgenommen Schäden, die durch Beachtung der Hausordnung oder der für die Veranstaltung auf der Website veröffentlichten Teilnahmebedingungen vermieden werden hätten können. Für sonstige Schäden haftet WNY nur, wenn WNY diese vorsätzlich oder grob fahrlässig verschuldet hat.

 

8. Auf diesen Vertrag über den Ticketerwerb ist ausschließlich österreichisches Recht anzuwenden, dies mit Ausschluss des UN-Kaufrechtes. Gerichtsstand für alle wie gearteten Streitigkeiten aus dem Vertrag ist das sachlich für Steiermark zuständige Gericht.

9. Datenschutz: Für die Speicherung und Verarbeitung der aufgrund des Vertragsabschlusses zwischen Kunde und WNY gespeicherten Daten gilt die Datenschutzerklärung, welche auf der Website, auf der sich der Onlineshop befindet, abrufbar ist.

Mit dem Kauf dieser WNY HANDPAN SUMMER ACADEMY TICKETS für das Jahr 2024 erkennt der Käufer an, dass ab dem Zeitpunkt der Buchung, im Falle einer Stornierung des Tickets, eine Stornogebühr anfällt. Die Stornierungsbedingungen für das Jahr 2024 lauten wie folgt:

Vom Datum des Ticketkaufs bis zum 9. Januar 2024 (6 Monate vor der Veranstaltung):

  • 80 % Rückerstattung an den Käufer (20 % verbleiben bei WNY als Bearbeitungsgebühr).

Zwischen dem 9. Januar 2024 und dem 9. Februar 2024 (5 Monate vor der Veranstaltung):

  • 50 % Rückerstattung an den Käufer - 50 % verbleiben bei WNY als Veranstalter.

Zwischen dem 9. Februar 2024 und dem 9. März 2024 (3 Monate vor der Veranstaltung):

  • 20 % Rückerstattung an den Käufer - 80 % verbleiben beim Verkäufer/Veranstalter.

Ab dem 1. April 2024 bis zum 9. Juli 2024 (zwischen dem 1. April 2024 und dem 9. Juli 2024) erfolgt keine Rückerstattung. 100 % des Ticketkaufpreises verbleiben beim Verkäufer dieser Tickets (WNY).

Bitte beachten Sie, dass ab dem Zeitpunkt des Ticketkaufs bis 3 Monate vor der Veranstaltung keine Rückerstattung möglich ist. Stornierungen nach diesem Zeitpunkt führen dazu, dass der volle Ticketpreis einbehalten wird, und es erfolgt keine Rückerstattung.

Diese Stornierungsbedingungen gelten ausschließlich für die WNY HANDPAN SUMMER ACADEMY 2024 Veranstaltung vom 9. bis 16. Juli 2024.

USING ONLINE TICKETS

  1. By ordering through online sales, the buyer (customer) declares that they have reached the age of 18 at the time of ordering.

  2. Ordering: The order is placed by clicking the "Buy/Proceed to Checkout" button and constitutes a binding offer by the customer to purchase a ticket (entitling them to attend the event). WNY is not obligated to accept this offer from the buyer. The contract for the purchase of the ticket is concluded after payment, with the ticket being made available on the WNY HANDPAN SUMMER ACADEMY website from July 09-16.July 2024 | Wild Naya. Payment is considered complete when the money transfer is authorized by the credit card company or bank. If no authorization occurs, the contract is not deemed to have been established.

  3. Payment: Payment for online tickets can only be made through valid, non-cash payment methods (e.g., credit card, electronically confirmed money transfer, debit card). If the identity of the buyer does not match that of the payment provider, WNY may reject the conclusion of the contract.

  4. Delivery/Issuance of the Ticket: The ticket can be retrieved by the customer immediately after the contract has been established (non-cash payment). The ticket is transmitted in PDF format or as mobile tickets to the email address provided by the customer. The customer must either print the ticket or save it as a mobile ticket. If no payment as per Section 3 has been made, and a ticket has nonetheless been provided, WNY is entitled to deny the buyer access to the event.

II. TERMS AND CONDITIONS FOR PARTICIPATION IN EVENTS - WNY Handpan Summer Academy 2024

  1. These General Terms and Conditions apply to events organized by WNY HANDPAN SUMMER ACADEMY, which include summer academies, artistic performances, workshops, conferences, etc. Additional specific conditions for participation in the event can be found in the information published by WNY for the event on the website.

  2. The information on the WNY website or in other WNY publications regarding the content and subject matter serves as preliminary information about the possible content of the event. WNY is authorized to make changes to the content and schedule of the event, provided it does not completely alter the nature of the event.

  3. WNY can change the start time of the event, postpone the event, or cancel the event. Changes to the start time, rescheduling of the event, or the cancellation of the event will be published on the WNY website no later than the day before the event.

  4. The ticket purchased for the event entitles the customer and/or the individuals named in the order to participate in the event indicated on the ticket. The transfer of tickets to individuals not named in the order is prohibited, except if otherwise specified in the event announcement. Upon entry to the event, the visitor is obliged, at the request of WNY, to prove their identity. The customer undertakes to comply with the house rules (published on the WNY website at www.wildnaya.com & www.wildnaya-academy.com AGBs) and the participation conditions published on the website for the event. In the event of non-compliance, entry to the event may be denied.

  5. Price: The ticket price includes the statutory value-added tax. Upon request from the customer, WNY will issue an invoice conforming to the provisions of the Value Added Tax Act and transmit it electronically.

  6. In the event of the cancellation of the event, WNY will reimburse the ticket price paid by the customer. If WNY has rescheduled the start of the event to a different day (no later than one day before the scheduled start of the event), the customer is entitled to cancel the ticket purchase by email, citing the ticket order number. In this case, WNY will refund the purchase price. No other refund or cancellation options or other contractual withdrawal options are expressly granted; the services in question are excluded from the right of withdrawal as so-called "date-bound leisure services" under § 18 of the Distance and Foreign Trade Act (FAGG).

  7. WNY is not liable for damages or disadvantages arising from the cancellation of the event or the rescheduling of the event's start (see Section 3). WNY is liable for personal injuries resulting from participation in the event, except for damages caused by infectious diseases and except for damages that could have been avoided by complying with the house rules or the participation conditions published on the event website. WNY is only liable for other damages if it has caused them intentionally or through gross negligence.

  8. Austrian law applies exclusively to this contract for the purchase of tickets, with the exclusion of the UN Convention on Contracts for the International Sale of Goods. The local court for the state of Styria has jurisdiction for all disputes arising from this contract, regardless of their nature.

  9. Data protection: The storage and processing of data stored as a result of the contract between the customer and WNY is subject to the data protection declaration, which is available on the website hosting the online shop.

With the purchase of these WNY HANDPAN SUMMER ACADEMY TICKETS for the year 2024, the buyer acknowledges that from the moment of booking, if the ticket is canceled, a cancellation fee will apply. The cancellation conditions for the year 2024 are as follows:

​

  • From the date of ticket purchase until January 9, 2024 (6 months before the event):

    • 80% refund to the buyer (20% retained by WNY as a processing fee).

  • Between January 9, 2024, and February 9, 2024 (5 months before the event):

    • 50% refund to the buyer - 50% retained by WNY as the organizer.

  • Between February 9, 2024, and March 9, 2024 (3 months before the event):

    • 20% refund to the buyer - 80% retained by the seller/organizer.

  • Starting from April 1, 2024, until July 9, 2024 (between April 1, 2024, and July 9, 2024), there will be no refunds. 100% of the ticket purchase price will be retained by the seller of these tickets (WNY).

Please note that from the moment of ticket purchase until 3 months before the event, no refunds are possible. Cancellations after this point will result in the full ticket price being retained, and no refund will be issued.

These cancellation conditions apply exclusively to the WNY HANDPAN SUMMER ACADEMY 2024 event from July 9 to July 16, 2024.
